Echo Terms of Service

Welcome to Echo

Thank you for choosing Echo! These Terms of Service ("Terms") form an agreement between you and Echo Technologies Pty Ltd ("Echo," "we," "us," or "our"). These Terms govern your use of our website, mobile application, and related services, collectively referred to as the "Services." By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, you may not use our Services.

Key Features and Scope of Services

Echo provides AI-powered mental health support designed to assist with everyday challenges through conversational techniques like Cognitive Behavioral Therapy (CBT). While Echo offers assessments that users can export for personal reference, it does not provide clinical diagnoses or treatment for severe psychological conditions, including but not limited to suicide prevention, eating disorders, personality disorders, and dissociative disorders. If such concerns arise, Echo will notify you of its limitations and recommend seeking professional assistance.

 

Use of Services

Eligibility

To use Echo's Services, you must:

  • Be at least 13 years old (16 years old for residents of the European Union).

  • Provide accurate, complete information during registration.

  • Use the Services in compliance with applicable laws.

If you are underage or otherwise ineligible, you may not use the Services.

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.

  • All activities occurring under your account.

  • Notifying Echo immediately of any unauthorized access or security breaches.

General Usage Limits

Echo reserves the right to:

  • Set data retention limits or delete inactive accounts after prolonged periods.

  • Update usage policies and practices with or without prior notice.

Notifications

By using our Services, you consent to receive notifications via email. These include updates about your account, changes to our Services, or promotional content.

 

User Conduct

Prohibited Activities

You agree not to:

  1. Use the Services for any unlawful, harmful, or abusive purpose.

  2. Submit or share content that:

    • Infringes intellectual property rights.

    • Contains harmful code or viruses.

    • Promotes violence, hate speech, or self-harm.

    • Provides medical, legal, financial, or tax advice.

  3. Disrupt the Services, impersonate others, or harvest personal information without consent.

  4. Reverse-engineer, copy, or modify the Services without authorization.

Echo reserves the right to investigate and act against violations, including suspending accounts and notifying law enforcement.

 

Intellectual Property

When you use Echo, you retain ownership of any content you create. However, by using the Services, you grant Echo a non-exclusive, worldwide, royalty-free license to use your content for the purpose of improving and operating the Services.

Echo Content

Echo and its associated trademarks, logos, and features are protected by intellectual property laws. You may not use Echo’s trademarks without prior written consent.

 

Disclaimer and Limitations

Disclaimer

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Echo does not guarantee:

  1. Accuracy or reliability of generated responses.

  2. Suitability of the Services for specific medical or therapeutic needs.

The Services are not a substitute for professional mental health care. If you are in crisis, seek immediate help from qualified professionals or emergency services.

Limitation of Liability

To the fullest extent allowed by law, Echo is not liable for:

  • Indirect, incidental, or consequential damages.

  • Content inaccuracies or user decisions based on AI-generated outputs.

 

Dispute Resolution

Arbitration Agreement

By using Echo, you agree to resolve disputes through binding arbitration, waiving your right to a jury trial or class action. Specific arbitration procedures will be outlined upon request.

 

Termination of Services

Echo may suspend or terminate your account if you violate these Terms. Termination does not affect Echo’s rights to retain or use content you’ve submitted under these Terms.

 

Changes to Terms

Echo reserves the right to modify these Terms. Updates will be posted with a clear revision date, and changes become effective 14 days after posting unless otherwise stated.
